Prison Services Disputes Allegations Regarding Presidential Pardon Recipient’s Conviction for Rape

The Gambia Prison Services (GPS) has released an official clarification addressing allegations circulating on social media, which assert that an individual who received a presidential pardon earlier this year was convicted of rape.

In a response to a report published by Wats-on-Gambia, the Prison Services characterized the information as factually erroneous, clarifying that the person in question, Essa Jarju, was convicted of manslaughter rather than rape.

The GPS emphasized that manslaughter constitutes a legally separate offense under Gambian law, and the continued mischaracterization of the former inmate as a rapist is both inaccurate and misleading.

Furthermore, the Prison Services pointed out that the aforementioned publication did not present any official court documents or judicial determinations that could substantiate a conviction for rape. The agency asserted the importance of accurately reflecting the legal charges and judicial decisions in public discussions surrounding criminal matters, rather than conflating different offenses.

Additionally, the Prison Services elucidated its function regarding the Prerogative of Mercy, underscoring that presidential pardons are conferred strictly in accordance with the Constitution and relevant legal protocols. The agency clarified that, while it is tasked with the lawful custody and management of inmates, it does not possess the jurisdiction to decide who is eligible for or receives a presidential pardon.
